1. Acceptance of Terms
By accessing or using TheRose Cloud, a Minecraft server and Discord bot hosting service provided by TheRose Cloud (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.
2. Account Registration and Use
a. Eligibility
- Users must be at least 13 years old.
- Users under 16 must have parental or guardian consent.
b. Accurate Information
You agree to provide accurate, complete, and up-to-date information during registration and usage of our services.
c. Account Security
You are responsible for safeguarding your account credentials. Any activity on your account is your responsibility. Report unauthorized access immediately at admin@therose.cloud.
3. Termination of Accounts and Services
a. Grounds for Termination
TheRose Cloud may suspend or terminate your account, server, or access to services for:
- Violating these Terms or applicable law
- Exploiting free trials, promotions, or creating multiple accounts to gain advantages
- Conduct harmful to the community, infrastructure, or reputation
- Non-payment or fraudulent payments
- Inactivity or technical abuse
b. Effects of Termination
Upon termination, you lose access to servers, bots, and associated data. TheRose Cloud may retain necessary information for legal, operational, or security purposes.
4. User Conduct
You agree to:
- Comply with all applicable laws and platform rules (Minecraft EULA, Discord TOS)
- Not upload, share, or transmit content that is illegal, offensive, harassing, or harmful
- Not attempt to interfere with our services, servers, or other users
- Not abuse promotions, free trials, or create multiple accounts to circumvent limitations
5. Minecraft & Discord Rules
- You must comply with Mojang’s Minecraft EULA: https://www.minecraft.net/en-us/eula
- Discord bot usage is limited to intended commands and functionality; abuse, spam, or attempts to crash the bot are prohibited.
- All server and bot IDs, UUIDs, and logs may be collected for security, debugging, and service optimization.
6. Intellectual Property
TheRose Cloud retains all rights to its services, website, software, and Discord bot.
Content you submit grants TheRose Cloud a non-exclusive, royalty-free license for service operation, improvement, or promotional use.
7. Payments and Refunds
- All payments for services, including subscriptions, premium plans, or wallet credits, are non-refundable, except in exceptional cases handled case-by-case.
- Multi-account abuse or promotion exploitation can result in revocation of credits, server access, and account suspension without refund.
8. Server Access and Maintenance
TheRose Cloud staff may access servers for:
- Technical support, maintenance, or security purposes
- Investigating abuse or performance issues
- Backups and data integrity checks
All attempts will minimize disruption, but uptime or gameplay cannot be guaranteed during maintenance.
9. Backups and Data Responsibility
- We provide best-effort backups.
- Users are responsible for their own data.
- TheRose Cloud is not liable for data loss due to misuse, hardware failure, or software errors.
10. Force Majeure
TheRose Cloud is not liable for delays or failures due to circumstances beyond our control, including natural disasters, wars, internet outages, pandemics, or governmental actions.
11. Limitation of Liability
To the maximum extent allowed by law, TheRose Cloud is not liable for:
- Indirect, incidental, or consequential damages
- Loss of data, revenue, or downtime
- Unauthorized access, server crashes, or external third-party issues
12. Dispute Resolution
- Governed by the laws of your country of residence or TheRose Cloud headquarters.
- Contact admin@therose.cloud first before opening disputes with payment providers.
- Accounts may be suspended if disputes are opened without prior contact.
13. Changes to Terms
We may update these Terms at any time. Continued use after changes constitutes acceptance.
